Strategies for Positive Management
Strategies for Positive Management (SPM) addresses common issues in supervision from an approach of using positive strategies to guide your employees toward growth and success. The course is highly interactive and discussion-based, and is intended to benefit both new and experienced supervisors and managers. It includes sections on motivation and engagement, positive coaching and feedback, and handling common challenges such as time management and effectively managing supervisor/supervisee relationships.

Americans with Disabilities Act (ADA): Fundamentals for Supervisors/Managers
As a supervisor, you are the key to creating a culture of inclusivity and ensuring that your employees’ ADA rights are respected. You also have significant responsibility for ensuring that the employer complies with the law and reduces liability for claims. In this class you will learn strategies to avoid inappropriate medical inquiries and actions that could be perceived as discriminatory or as interference with ADA rights; assist employees as appropriate in accessing information (including policies, forms and contacts) to request reasonable accommodation; assist as appropriate with evaluating and implementing reasonable accommodations; maintain confidentiality of the employee’s disability and accommodation; ensure that the employee is not discriminated or retaliated against by anyone as a result of having the accommodation; and create an inclusive and accessible work environment.

The Family and Medical Leave Act (FMLA) for Supervisors/Managers
The Family and Medical Leave Act of 1993 (FMLA) is an important workplace law that entitles eligible employees to take unpaid, job-protected leave for specified family and medical reasons, and to return to their same or an equivalent job at the end of their FMLA leave. As a supervisor, you have an important role in ensuring compliance with all applicable provisions of the FMLA for your employees. In this course, we will discuss FMLA key terms and definitions, including eligibility requirements, qualifying conditions, and leave entitlements; the process of FMLA requests and approvals, focusing on the supervisor’s role in that process and avoiding possible interference; SHARE time coding issues, including applying accrued leave, leave donations, and leave without pay; managing the employee’s absence, including maintaining confidentiality and avoiding inappropriate actions; return to work issues, including FML exhaustion, release documentation, employees who are not released to full duty, and retaliation prevention/response; and strategies to reduce and address possible abuse of FML time.

Living in a Union Environment
This training course was developed for supervisors and managers to help them understand that both management and unions have rights under the National Labor Relations Act (NLRA), the Public Employee Bargaining Act (PEBA) and the CBAs. This is an introductory course that gives a brief history of how the labor organizations came into the State, the grievance process, performance appraisals, arbitration, Prohibited Practice Complaints (PPC), and Labor Management Committees (LMC). This interactive course provides an overview of the CBAs, as well as interpretation of language and better understanding of processes and problem solving techniques. The Living in a Union Environment course received national recognition by the National Association of Personnel Executives (NASPE) in 2009. Finally, local universities in New Mexico have partnered with the LRB to adopt this training course for their needs.
Along with the introductory LIUE course, the LRB is developing an advanced class for state human resource managers and state agency attorneys. The advanced course is focused more on the legal responsibilities of the parties, how to prepare for arbitration and PPC hearings, and how to properly respond when disputes arise.

Workplace Investigations
Most managers, supervisors and human resource professionals will need to conduct at least one workplace investigation during the course of their careers. The goal of this training is to provide managers and supervisors with the tools to conduct workplace investigations utilizing methods applied by experienced workplace investigators. The State Personnel Office believes the objective of a good workplace investigation is to improve the factual basis of decision-making. the information provided in this course promotes conducting quality, prompt and fair investigations.
